कर्मचारी बीमा न्यायालय की शक्तियों पर संक्षिप्त टिप्पणी-
कर्मचारी बीमा न्यायालय के अधिकार ( Power Of Employees ' Insurance Court ) - कर्मचारी बीमा न्यायालय के प्रमुख अधिकार या शक्तियाँ निम्नलिखित हैं :
1 . दीवानी
न्यायालय के अधिकार (Power
Of Civil Court) -
कर्मचारी राज्य न्यायालय को दीवानी न्यायालय की तरह निम्न अधिकार प्राप्त हैं :
(I) गवाहों को बुलाना तथा उपस्थित होने के लिए बाध्य करना ।
(
Ii ) प्रलेखों को प्रस्तुत करना ।
(
Iii ) शपथ दिलाना तथा
(
Iv ) गवाही का लिखना ।
ऐसा न्यायालय दंड प्रक्रिया संहिता ( Indian Penal Code ) की धारा 195 के अन्तर्गत दीवानी | न्यायालय माना जायेगा ।
2 . कार्य
- प्रक्रिया ( Procedure ) - कर्मचारी बीमा न्यायालय में ऐसी कार्यविधि को अपनायेगा जो राज्य सरकार द्वारा बनाये गये नियमों के अधीन निर्धारित की जाये ।
3 . कार्यवाही
के व्यय ( Cost Of Proceedings ) - कर्मचारी बीमा न्यायालय में चल रही कार्यवाही के व्यय कोन वहन करेगा ? इस सम्बन्ध में राज्य सरकार द्वारा बनाये गये नियमों के अधीन न्यायालय तय करेगा।
4 . आदेशों
को लागू करना ( Enforcement Of Order ) - न्यायालय के आदेश उसा प्रकार स लागू किये जायेंगे जैसे दीवानी न्यायालय द्वारा किसी विवाद में दी गई डिक्री लागू होती है ।
5 . उच्च
न्यायालय को सन्दर्भ ( Refer To High Court ) - कर्मचारी बीमा न्यायालय कानून सम्बन्धी कोई भी प्रश्न उच्च न्यायालय के समक्ष निर्णय हेतु प्रस्तुत कर सकता है । यदि वह ऐसा करता है तो उस प्रश्न का हल उच्च न्यायालय के निर्णय के अनुसार होगा ।
6 . अपील
( Appeal
) ( धारा 82
) - कर्मचारी बीमा न्यायालय के निर्णय के विरुद्ध केवल ' कानून के प्रश्न ' ( Question Of Law ) पर ही
उच्च न्यायालय में 60 दिन के अंदर , अपील की जा सकेगी । ' तथ्य के प्रश्न ' ( Question Of Fact ) पर कर्मचारी बीमा न्यायालय के निर्णय अंतिम होंगे ।

Rights
of Employees Insurance Court The following are the main powers or powers of the
Employees Insurance Court.
1.
Power of Civil Court - Employees' State Court has the following powers as a
civil court:
(I)
To summon and compel witnesses to appear.
(Ii)
Submission of documents.
(Iii)
administer oaths and
(Iv)
Writing of testimony.
Such
a court under section 195 of the Indian Penal Code. To be considered a court.

. Procedure - Employees shall adopt such procedure in the Insurance Court which
may be prescribed under the rules made by the State Government.

Cost of Proceedings - Who will bear the expenses of the proceedings going on in
the Employees Insurance Court? The court will decide the rules made by the
state government in this regard.
4.
Enforcement Of Order - Court orders will be applied in the same way as a decree
given by a civil court in a dispute.
5.
Refer to High Court - Any question related to Employee Insurance Court law can
be submitted before the High Court for decision. If he does so, the question
will be resolved according to the decision of the High Court.
6.
Appeal (Section 82) - Only the 'Question of Law' against the decision of the
Employees Insurance Court can be appealed to the High Court within 60 days. The
decisions of the Employees Insurance Court on the 'Question of Fact' will be
final.
